Privacy Policy

Our history is marked by security, transparency, and commitment in everything we do. With your personal data, it couldn't be different! Here at Softruck, we know that your privacy is a right that deserves to be preserved. That's why we created this document, so you know how we use, what we use, and how we protect the information entrusted to us.

1. What personal data is processed?

Contractual data:

When you hire Softruck's services, we collect some information about you, such as full name, RG, CPF, email, address, cell phone number, and signature. In addition, you may complete your data on our platform and include the data of your own clients, such as profile name, profile picture, contact phone numbers, addresses, brand, model, and identification of the vehicles managed and linked to your client (in this case, it is worth remembering that it is up to you to be responsible for the processing and decision-making regarding such information, while Softruck will only act as Operator of this data).

We also collect some data from candidates for vacancies in selection processes and from people hired by Softruck, for the celebration of the employment contract or provision of services, depending on the case.

Usage and registration data:

Some information about activities on the Softruck platform may also be collected, such as how our services are used, how interaction with other users occurs during the use of services, as well as diagnostic reports, failures, website, and performance.

Device and connection data:

We collect specific data about location devices installed in vehicles when connected to Softruck servers. This includes data such as installed hardware model, IP address, data about the mobile network of the SimCard embedded in the equipment, latitude and longitude, device identifiers, and signal accuracy. Device location data is collected and stored by Softruck, comprising the movements made by the respective vehicles registered on our platform.

Cookies:

Cookies are used to operate and provide the services offered by Softruck, in addition to observing visit habits. They allow us to remember your language and login preferences, deliver ads, and improve your experience on our site. You can control how this happens by consulting your browser's instructions to adjust or change your settings. Note: some cookies are essential for the functioning of the site. Blocking them may affect the functioning of your experience and make access to certain website functions and tools impossible.

Vehicle information:

Vehicles will be registered on our platform directly by the person who hired our services. Geo-referential data is obtained and transferred to the Softruck platform through the device (GPS tracker) installed in the vehicle and linked to its registration. There, the user himself can enter complementary information about his route preferences, most used addresses, and other data, with the aim of improving his experience and expanding the application's functionalities.

2. How do we use your data?

The types of personal data we collect and how we do it depend on how and why you interact with us. Here, we describe how this happens and what the objectives of each activity are:

Softruck processes information for the following purposes: to fulfill a contract or preliminary procedures related to a contract; operate and provide Services; offer support, improve, correct, and customize the Services; improve user experience and Services offered; understand how Users use the Services; research and development of new services, features, and resources, as well as to solve any problems.

The insertion of Users' personal data into the Softruck platform is done directly by the Contractor, who is responsible for collecting, processing, and making decisions about this information. In this case, it is up to the Contractor, as the Controller, to inform its clients how, for what, and for how long this will be done, making it clear that Softruck acts only as a Data Processor in this relationship and is not responsible for any irregularity committed by the Contractor.

Therefore, this Privacy Policy does not apply to personal data collected by Contractors. Such data must be treated in accordance with the privacy policies of the Contractors themselves, who are the legal entities responsible for their processing. However, if the User enters their personal information into the platform and creates, views, or edits items related to their account, this data will be treated according to the terms of this Policy. After the end of data processing, within the technical limitations of the activities, the information will be stored for the time necessary to: (i) fulfill legal or regulatory obligations; (ii) transfer to third parties, respecting the data processing requirements provided for in the LGPD; (iii) exclusive use by Softruck, through anonymization of the data.

3. With whom do we share your data?

During the performance of activities and to provide the contracted services, Softruck may share data with third-party service providers.

These service providers will be hired to assist in operations, execution, improvement, understanding, customization, support, and disclosure of services provided by Softruck. They may be companies hired to distribute applications, provide customer support, set up infrastructure systems, and provide information about maps and locations. In some situations, data may be transferred to servers located outside of Brazil.

When sharing data with third-party service providers, Softruck explicitly establishes that the shared data can only be used for the specific purposes of providing the contracted services. Service providers are responsible for the security of data processing, access to this data, and for strictly processing it, as authorized by Softruck.

In addition, personal data may be shared to comply with legal, judicial, or regulatory obligations. Softruck does not commercialize or share any type of personal data that is processed and inserted into the platform.

4. How do we protect your data?

The security, confidentiality, and privacy of the personal data we process are top priorities for Softruck. To ensure this, we have implemented structured systems that meet security, best practices, and governance requirements, as required by privacy and data protection laws. Our commitment is to protect your data against any unauthorized access, alteration, disclosure, or destruction, by adopting the best technical and administrative security measures. This includes:

i) Daily backup of systems and data stored in the cloud;

ii) Use of non-transferable user IDs and passwords by employees and contracted service providers;

iii) Use of Firewall to prevent unauthorized access to Softruck servers and its system;

iv) Use of encryption to maintain data privacy, when applicable;

v) Analysis of collection, storage, and processing information practices, including physical security measures, to prevent unauthorized access to systems; and restricting access to the database.

The information received or collected is stored in a secure and controlled environment called the Database. This database has multiple security levels and can only be accessed by users accredited and authenticated by Softruck. These users have contractual obligations to preserve the privacy and protection of the stored data.

We are constantly updating our knowledge in terms of technology and applicable legislation. We conduct periodic reviews of the techniques used to constantly improve our security, processes, policies, and data protection techniques. However, it is important to note that we cannot guarantee complete inviolability of our services. But rest assured: our team is prepared to detect and promptly respond to events or incidents that may compromise the security of your data or our services.

In addition to the protection measures implemented by Softruck in its Database, it is highly recommended that Contractors and Users adopt good security practices to prevent unauthorized access to data registered on the platform. In this document, you will find information on how to increase security in your operations.

5. How do we manage and store your data?

The personal data of the User and the Contractor will be stored in our Database for the time necessary to provide the contracted service or product.

If desired, the Contractor can request the deletion of an account at Softruck at any time. When an account is deleted, all personal data is encrypted and maintained in an anonymized manner, without any reference to the old ownership. This information is used only for internal analysis and exclusively by Softruck.

Personal data will be kept for reasons such as: (i) fulfilling the purposes described in this Privacy Policy, (ii) meeting deadlines determined or recommended by regulatory bodies, professional organizations, or associations; (iii) complying with applicable laws, legal detentions, and other legal obligations; (iv) fulfilling contractual obligations; (v) meeting requests; (vi) defending against judicial processes, and (vii) exercising legitimate interests.

6. Violations of our Policy

Violations of this Policy, as well as other norms and procedures for the protection of personal data, by Softruck Employees, will be subject to penalties, which may include warning, unpaid suspension, and even dismissal for cause. Softruck will analyze the seriousness of the offense, its effects, recurrence, and will consider the hypotheses provided for in Article 482 of the Consolidation of Labor Laws.

In the event of violations of this Policy or Law No. 13,709/18 by Third Party Contractors or Service Providers, Softruck will evaluate the situation and take appropriate measures, including immediate termination of the contract and seeking compensation for losses and damages.

In cases of violations involving illegal activities, risks to the holders of personal data, or harm to Softruck, the offender will be held responsible for the damages caused. Appropriate administrative and judicial measures will be applied to deal with these situations.

7. Updates to our Policy

Softruck is always in constant evolution, growth, and improvement of its processes. For this reason, this Privacy Policy may be updated at any time, without prior notice or notification. Whenever we make changes to this Policy, we will update the date of the last modification. We recommend that you visit this page periodically to stay informed about any changes.

By continuing to use the Services provided by Softruck, you confirm your acceptance of this Privacy Policy.

8. How to contact us?

According to applicable law, when Softruck acts as a Data Controller, data subjects have the right to request information about the collection and processing of data, access their own data, correct information, and exercise other rights provided for in Article 18 of the General Data Protection Law (Law No. 13,709, of August 14, 2018).
